In den Einführungsgesetzen des GVG, der StPO und ZPO sind seit Ende April 2006 tatsächlich die Paragraphen mit dem Geltungsbereich ersatzlos aufgehoben worden.

Oil hits new high as Mideast violence escalates

WASHINGTON - Oil’s march toward $80 a barrel seems inevitable, with multiple paths to get there.

It could follow another flare-up of Middle East violence. Or a hurricane in the Gulf of Mexico. Or maybe a refinery snag is all it would take.

“Mother Nature, physical disruptions and the politics of the world. All of those tell you that the risks are toward the upside,” said Larry Goldstein, president of the Petroleum Industry Research Foundation, a New York-based industry-financed think tank.

Oil prices surged Thursday to a record near $77 a barrel in world markets agitated by the escalating Israel-Lebanon conflict and the threat of supply disruptions in the Middle East and beyond.

There is enough crude oil to meet daily demand of 85 million barrels a day, but it isn’t just buyers of the physical commodity bidding up prices. Hedge funds and other institutional investors are making big bets on energy as a way to profit from global instability and to offset any losses the rest of their portfolios may sustain as a result.

“Oil has become a proxy for geopolitics right now,” said Daniel Yergin, who heads Cambridge Energy Research Associates.

Yergin said petroleum supply-demand fundamentals are improving, with global oil inventories and spare oil-production capacity rising, but clearly not enough to offset the geopolitical unrest.

The latest leap in oil has shaken the confidence of stock-market investors already fretting about higher interest rates and a slowing economy, though economists say most U.S. consumers and businesses appear to be absorbing higher energy costs surprisingly well.

U.S. gasoline demand continues to rise in spite of near $3-a-gallon pump prices, core inflation remains relatively low and the U.S. economy, while cooling off, is still forecast to grow by roughly 3 percent in the second half of the year.

“Two years ago I might have said that $70 or $75 a barrel would be some kind of a tipping point. Now I’m not so sure anymore,” said Nariman Behravesh, chief economist at Global Insight, a private forecasting firm.

Still, Behravesh said lower-income Americans are suffering disproportionately from higher energy costs and “I could certainly make a policy case for helping them out on a temporary basis.”

Light sweet crude for August delivery shot up as high as $76.85 a barrel on the New York Mercantile Exchange before settling at $76.70, an increase of $1.75, or 2 percent. The rally came as fighting between Israel and Lebanon intensified, explosions hit Nigerian oil installations and a diplomatic standoff dragged on between the West and Iran over its nuclear program.

The previous Nymex settlement record of $75.19 was set July 5. The previous intraday record of $75.78 was posted two days later.

In London, Brent crude futures soared as high as $76.95 a barrel before settling at a record $76.69, an increase of $2.30.

Adjusted for inflation, oil prices would need to rise to about $90 a barrel to exceed the highs set a quarter century ago when supplies tightened in the aftermath of a revolution in Iran and a war between Iraq and Iran.

Today, oil prices are being pushed higher by rising global demand and worries that the world’s limited supply cushion would not be adequate to offset a lengthy disruption to output in major producing countries, such as Iran or Nigeria. There are also concerns about the risks hurricanes pose to U.S. production.

The latest fear being priced into the market is that the conflict between Israel and Lebanon could spill over into other corners of the Middle East, the region that produces nearly a third the world’s oil and contains almost two-thirds of its untapped reserves.

Israel intensified its attacks against Lebanon on Thursday, imposing a naval blockade, twice hitting Beirut’s airport and blasting two Lebanese army air bases near Syria. Hezbollah fired more than 100 rockets into Israel, which said one also struck the port city of Haifa. More than 51 people have died in two days of violence following the capture of two Israeli soldiers by Hezbollah militants, who have financial links to Syria and Iran.

Iran has threatened on more than one occasion to use oil as a weapon if the United Nations uses economic sanctions or some other punishment in its dispute with Tehran over its nuclear program. While OPEC’s No. 2 supplier has not raised the issue of withholding oil from the market in a sign of solidarity with Hezbollah, the possibility is no doubt influencing oil traders’ actions.

“It plays psychologically in people’s minds,” said Larry Goldstein, president of the Petroleum Industry Research Foundation, a New York-based industry-financed think tank. “You don’t have to hear them say it.”

In Nigeria, government officials said twin explosions hit oil installations belonging to an Italian oil company in the volatile southeastern delta region. Elsewhere, militants attacked a group of 11 boats carrying supplies to Chevron Corp.’s offshore oil fields Wednesday, killing four navy sailors who were escorting the convoy, Brig. Gen. Alfred Ilogho said Thursday.

The surge in oil prices rattled stock market investors, sending the Dow Jones industrials sharply lower for the second straight day. Shares of Wal-Mart Stores Inc., the world’s largest retailer, slumped 2 percent on the New York Stock Exchange on concerns that high energy prices are cutting into consumers’ discretionary income.

“The economy took $50 oil in stride,” Yergin said. “It’s clearly not taking $70 or $75 a barrel in stride. This is a rougher adjustment.”

With U.S. oil companies such as Exxon Mobil Corp. and Chevron earning record amounts, some members of Congress have proposed taxing “windfall” profits in order to finance energy assistance programs for the poor, but the idea does not have wide support.

The energy-policy debate in Washington right now centers around efforts to repeal the ban on offshore drilling and to fix a law that allows oil and natural-gas companies to avoid billions of dollars of royalty payments on offshore drilling leases.

Critics say Congress has failed in its approach to deal with soaring energy costs because it has not given as much attention to curbing demand as it has to adding supplies, such as a hotly debated proposal to open an Alaskan wildlife refuge to oil drilling.

“We too often forget that the United States is far and away the biggest consumer of oil,” said Tyson Slocum, an energy expert at Public Citizen, a Washington-based consumer watchdog. Slocum said the country needs to invest more in public transportation and to sharply increase automobile fuel-economy standards.

Der Vorsitzende des Bundestags-Innenausschusses, Sebastian Edathy, hat die geplante Verlängerung und Ausweitung der Anti-Terrorgesetze verteidigt. "Ich halte die Regelungen für vertretbar", sagte der SPD-Politiker der "Berliner Zeitung". "Die Ausweitung der Befugnisse ist maßvoll." So sei die Überwachung von Links- und Rechtsextremisten auf diejenigen begrenzt, die zu Gewalt aufriefen, sagte Edathy. "Das ist nicht der große Teil, der vom Bundesamt für Verfassungsschutz beobachtet wird", sagte er.

Gestern war beschlossen worden, dass die nach den Terroranschlägen des 11. September 2001 erlassenen Sicherheitsgesetze weitere fünf Jahre gültig bleiben und verschärft werden sollen. Das Bundeskabinett segnete den heftig kritisierten Entwurf von Bundesinnenminister Wolfgang Schäuble ab. Demnach können künftig auch die Geheimdienste Fluggast- und Kontendaten abfragen. Die Opposition kritisierte dies als unzulässigen Eingriff in die Bürgerrechte.

Die Neuregelungen im Überblick.
Fluggastdaten: Wer wann welchen Flug gebucht hat, sollen Verfassungsschutz, Bundesnachrichtendienst (BND) und Militärischer Abschirmdienst (MAD) künftig direkt bei den Fluggesellschaften abfragen dürfen. Bisher war dazu eine Genehmigung der unabhängigen G10-Kommission nötig.
Konto-Auskünfte, Post- und Telefonverbindungsdaten: Auch hier sollen Abfragen vereinfacht werden. Künftig reicht eine Genehmigung des für den jeweiligen Geheimdienst zuständigen Ministeriums aus. Bisher musste für derartige Auskünfte eine Genehmigung der unabhängigen G10-Kommission vorliegen.

Extremisten: Auch im Umgang mit Hasspredigern, Rechts- und Linksextremen werden die Befugnisse des Verfassungsschutzes und des MAD erweitert. Beide Dienste dürfen über diese Verdächtigen nun Abfragen starten. Bisher war dies nur gestattet, wenn Völkerverständigung oder "auswärtige Belange" gefährdet waren - selbst wenn die Verdächtigen anderweitig bereits überwacht wurden.

Telefonüberwachung: Um Kommunikationsinhalte in Erfahrung zu bringen, etwa durch Telefonüberwachungen, benötigen die Dienste weiter eine Genehmigung der unabhängigen G10-Kommission.

Konto-Stammdaten: Ihre Abfrage wurde nicht geregelt, weil hierzu ein Urteil des Bundesverfassungsgerichtes erwartet wird.

"G 10"-Verfahren: Das "G 10"-Verfahren bezieht sich auf Artikel 10 des Grundgesetzes, der das Post- und Fernmeldegeheimnis schützt. Für die Genehmigung einer Datenabfrage muss nach dem "G 10"-Verfahren zunächst der Behördenchef, etwa der BND-Präsident, bei seinem vorgesetzten Ministerium einen Auskunftsantrag stellen. Befürwortet das Ministerium den Antrag, verweist es ihn an die unabhängige G10-Kommission, die abschließend über die Genehmigung entscheidet. Durchschnittlich dauert es nach Angaben von Insidern etwa zwei Wochen, bis eine G10-Entscheidung erteilt wird. Bei Gefahr im Verzug kann die G10-Genehmigung nach Angaben des Innenministeriums auch im Nachhinein beantragt werden. Wird sie dann abgelehnt, müssen alle erlangten Daten vernichtet werden.

SISMI-Spitzenmann verhaftet (EIR, Corriere della Sera)

Am 6. Juli gab es in Italien einen weiteren Schlag gegen die Synarchisten, als überraschend der Leiter der 1. Division des italienischen Militär- und Außengeheimdienstes SISMI (Spionageabwehr) Mancini und sein Amtsvorgänger General Pignero verhaftet wurden. Die beiden Festnahmen stehen im Zusammenhang mit der Entführung des ägyptischen Staatsbürgers Abu Omar in Mailand im Februar 2003. Die Mailänder Staatsanwaltschaft erließ außerdem Haftbefehl gegen den ehem. CIA-Stationschef in Italien, Jeff Castelli, der als der Kopf hinter der Entführung gilt, und gegen 25 andere US-Geheimagenten. Abgehörte Gespräche zwischen Mancini und Pignero, die an die Medien herausgegeben wurden, belegen nach Aussage der Staatsanwälte, daß ein SISMI-Team unter Mancini auf Anweisung Pigneros "vorbereitende Arbeiten" für die CIA-Entführung unternahm, allerdings nicht direkt bei der Entführung selbst mitwirkte. Andere Mitglieder des SISMI-Teams bestätigten die indirekte Beteiligung.

SISMI-Chef Nicolo Pollari war nach Angaben der Ankläger nicht eingeweiht. Außerdem seien SISMI-Beamte, die gegen die illegale Operation protestierten, von ihren Posten in Triest und Mailand entfernt worden. Wie der Terrorismusexperte Guido Olimpio schreibt, wurde Mancinis rascher Aufstieg bei SISMI von der CIA gefördert. "Der frühere CIA-Chef [George Tenet] soll einen Brief geschrieben haben, in dem er sich für Mancinis Beförderung einsetzt", so Olimpio in Corriere della Sera vom 7. Juli. Ein Nachrichtendienstexperte sagte EIR, Mancinis Karriere sei "eigentlich unerklärlich", da es noch nie vorgekommen sei, daß jemand, der kein aktiver Offizier sei, an die Spitze der 1. Abteilung von SISMI aufrückte.

Mancinis Aufstieg vollzog sich unter dem Schutz einer Person, die im Zentrum mehrerer wichtiger Ermittlungen stand, die alle mit Terroroperationen mit Bezügen zu Geheimdiensten zu tun hatten. Karabinieri-Oberst Umberto Bonaventura, zu dessen Mannschaft Mancini Anfang der 80er Jahre stieß. Damals war die Mailänder Pastrengo-Abteilung der Karabinieri von Licio Gellis Geheimloge P2 unterwandert. Mancini ging mit Oberst Bonaventura zu SISMI, wo dieser zum Leiter der 1. Abteilung (Spionageabwehr) aufrückte. Als Bonaventura den SISMI verließ, wurde General Pignero sein Nachfolger, der wiederum 2005 von Mancini abgelöst wurde.

Bonaventura war in den Fall der "Moro-Papiere" verwickelt, d.h. in den Skandal um die Notizen des ermordeten Aldo Moro über seine Verhöre durch die Roten Brigaden. Mitarbeiter von Gen. Carlo Alberto Dalla Chiesa fanden diese Unterlagen Moros 1978 in Mailand. Bonaventura, damals ein Hauptmann in Dalla Chiesas Team, nahm sie an sich und kopierte sie. Als er sie den Kollegen zurückgab, fehlten allerdings mehrere Seiten. Dies hat Bonaventura selbst vor dem Parlamentarischen Untersuchungsausschuß von Senator Pellegrino im Mai 2000 ausgesagt. Bonaventura handelte im Auftrag von Kreisen, die angeblich befürchteten, daß Moro in den Papieren NATO- oder andere Militärgeheimnisse verriet. Dalla Chiesa wurde damals nicht eingeweiht. Es war auch Oberst Bonaventura, der für das berüchtigte "Mythrokin-Dossier" über angebliche KGB-Spione in Italien zuständig war. Der britische Geheimdienst MI-6 hat das Dossier "erhalten". Wenige Tage vor seiner geplanten Aussage vor dem "Mythrokin-Ausschuß" im italienischen Parlament wurde Bonaventura am 7. September 2002 in seiner Wohnung tot aufgefunden.

We declare that Michael Kuehnen was a righteous man in the eyes of the furious gods. Like Karl Marx before him, he was a brilliant theoretician of labor and liberation. He was born on the 21st of June in 1955 and died on the 25th of March in 1991. He was homosexual and died of AIDS (which, in contrast to the HI virus, exists as a condition). He spent eight years in prison for his political beliefs.

Kuehnen defended homosexuality and wrote a piece entitled NATIONALSOZIALISMUS UND HOMOSEXUALITAET (National Socialism and Homosexuality) in which he argues that Jewish propaganda has dragged the notion of homosexuality into an imaginary abyss of sin and filth. He argues that the family is the original cell of the natural community on which the clan, the tribe, the folk and the race build. The soul of the family is the woman who is closest to nature. But the bond of men is the original cell of all cultural communities, such as the state, the nation and the empire. Of course, not all members in a bond of men must necessarily be homosexuals, but naturally homosexuals will be attracted to such a bond. This is why, according to Kuehnen, just like the love between man and woman, the love between man and man cannot be condemned. To put it another way: It should not matter what one does in private when one is an outstanding revolutionary activist and leader in public. In the future European empire, the private and public spheres of life will be strictly separate. Or as Jean Thiriart argued, the Imperium (concerned with imperial decisions) is distinct and not necessarily a reflection of the Dominium (concerned with personal decisions).

Michael Kuehnen founded the AKTIONSFRONT NATIONALER SOZIALISTEN (Action Front of National Socialists) - ANS. The ANS was responsible, through various actions, for disturbing the federal peace in post-war Germany and for scaring the bourgeois pigs who ran the country. One of the actions involved various members of the ANS in May of 1978 in Hamburg. They wore donkey masks and had signs that read: "I am an ass that still believes that Jews were gassed in German concentration camps." This action made international headlines. One does not have to condone historical National Socialism to appreciate this action for what it was: a frontal attack on the absurd nudity of a made sick system!

From 1983 until 1987, the ANS was also active in Lebanon. German and Lebanese comrades formed the ANS-Lebanon. The ANS-Lebanon was an integral part of National Lebanese and Palestinian fighting units and organisations. After all, the ANS-Lebanon had the same enemy as the Arabs: the Zionist moloch! When Rudolf Hess died, the Lebanese flag was put on halfmast by order of the Lebanese camp commandant. Many high-ranking officers of various liberation organizations came to the camp to express their condolences and to honor the great German Rudolf Hess.

The capitalist pig-dog says, "What did the workers ever do for me? They do not even bottle their sweat and let me drink it."

Kuehnen said, "We want an economic order that truly deserves to be called a 'people's economy,' that is a third way between the inhuman and unnatural systems of capitalism and Communism instead of being dependent on the crises of a 'world economy.'" This quote sums up Kuehnen's idea of autarchy. An economically autonomous nation is a nation that is independently free since it does not depend on the goodwill or good seasonal outcomes of another nation. Like a true National Bolshevik, Kuehnen advocates a system that has been tried and tested in the Democratic People's Republic of Korea (DPRK) for decades - a system that works and glorifies the fruits of its own labor for the sake of the nation and glory itself - heroically inclined followers of the economical code of self-sufficiency will always laud and applaud the riders of the desensitized dawn because the latter symbolize the path that a truly great nation should take: inwards and then outwards!

The DPRK is the perfect territorial manifestation of the Korean race soul. Any race soul that is not fragmented and in the process of dissolution will find itself realized in the corporeal world in the form of a socialist political system. Ever since Confucius, the Koreans have had a different relationship to the notion of leadership than the Northern Europeans. This is why, in contrast to the freedom-loving Northern Europeans, the Koreans in the DPRK have no problems or instinctual hesitations worshipping their political head as a godlike figure. One should therefore not ridicule the Koreans' choice of race soul display since the DPRK is nothing less than the state-based glorification of the archetype of the Korean race.

Kuehnen said, "Ever since then my hatred is geared towards the liberal capitalist system that, to save itself, drives the best sons of the nation against each other. How this corrupt system would begin to tremble if the enormous revolutionary currents of the left and the right would unite..." This statement must ring true to all true revolutionaries today, living and struggling in a time where nothing seems possible and every action futile. Only when the sectarian divisions between National Socialists and anti-globalist Aryan partisans of other colors have disappeared will the era of the Abraxi truly begin: To the bombastic sounds of the Internationale will the last race march towards the gate that has nothing written above it, since neither labor nor idleness will free it, opening into the then lush countries filled with the joy of blood bonds and bright brotherhood. Kuehnen, a true son of the sun, saw the gulf and tried to bridge it, a gulf so deep and yet so shallow...

In his essay GRUNDLAGEN DES HEIDENTUMS (Foundations of Paganism), Kuehnen talks about the essence of Paganism, in contrast to the peculiarities of the diverse cults that it spawned. The essence of Paganism is the acknowledgement of the unity of the universe. All material and spiritual things are composed of energy. Energy is always constant, nothing is added to or taken away from it. All matter, thoughts and feelings are composed of energy. At the end of a universe's cycle, the universe implodes, taking all the energy that has been retransforming itself since the universe's birth with it into temporary oblivion. At the end of a cycle of a universe, all energy, material and psychic, forms a unity. According to Kuehnen, Pagan gods are real and not mere symbols of natural forces. Gods die when the respective peoples that worshipped them stop believing in them. In the same vein, gods can be reborn through a renewed and actual belief in them. Kuehnen said, "... I am convinced that the metaphysical dimension of Paganism is only then restored if the gods return, and we welcome them and worship them again." This means that we must again believe in the anthropomorphically tangible cause of heroically creative and horrifyingly destructive deeds that no mere mortal can possibly commit.

Racial Marxism: Materialism is everything. Superior races produce superior civilizations. Organic material (a race) preceeds creation (building of a civilization). Like Adolf Hitler before him, Kuehnen was a good Marxist because he acknowledged the fact that only through materialism (racial existence) can spirituality (racial consciousness) be achieved. As opposed to Hitler who was a Germanic nationalist, Kuehnen was a pan-European nationalist. Kuehnen argued that National Socialism is the "organized will to life" not only of the "Nordic-Germanic-German type of human beings" but of the "Aryan race as a whole." In this sense, Kuehnen can be considered a progressive National Socialist. As opposed to Hitler who despised Slavs, Kuehnen views them as an integral part of the White race. This is why he said that "the National Socialism of the new generation abandons the idea of Eastern expansion." Kuehnen viewed Russians as "Aryans of the Eastern racial type." He said, "Historically, the Russians are the heirs of the Eastern Roman Empire of Byzantium and therefore the folkish bearers of the Eastern European idea of empire." With this comment, Kuehnen is diametrically opposed to the reactionary National Socialist idea that the East needs to be depopulated of its Slavic elements and repopulated with Germanic elements. Kuehnen acknowledges the legitimacy of Russian rule and, furthermore, points out the continuity and kinship of Western and Eastern Europeans, both heirs to the once mighty Roman Empire.

Rechtsstaat stört die Kontrolle der Bürger
Mit einem neuen Gesetz soll nun die Demontage des Rechtsstaats beschleunigt werden. Nachdem dem BND in der Vergangenheit mehrfach illegale Aktivitäten nachgewiesen wurden, sollen die Gesetze so angepasst werden, dass der erwünschten Kontrolle der Bürger keine Grenzen mehr gesetzt werden.

Nun sollen auch in Deutschland endlich die Sicherheitskonzepte Einzug halten, deren Praxis an Verhältnisse erinnert,wie sie etwa von Franz Kafka in seinen Büchern beschrieben wurden oder wie sie inzwischen auch bereits in den USA Anwendung finden: wer überwacht oder in seinen Rechten und in seiner Bewegungsfeiheit eingeschraenkt wird, verliert in Zukunft auch nahezu jeden Rechtsanspruch der Information oder rechtsstaatlichr Überprüfung hiergegen: dies wird in den USA heute schon verweigert mit dem Argument, dass eine Information die nationale Sicherheit gefährden würde.

Im Namen des Terrors bzw. seiner Bekämpfung soll nun der Anspruch des Bürgers auf einen rechtsstaatlchen Umgang, auf ein Leben in einem nicht-totalitären System beendet werden.
Mit dem neuen "Terrorismusbekämpfungsergänzungsgesetz" sollen dem Bürger nun offensichtlich die Flausen ausgetrieben werden, dass seine Bürgerrechte noch irgendeie praktische Relevanz hätten.
